1. Acceptance of Terms
These Terms and Conditions (“Terms”) form a binding agreement between you and Kaempfer Finance (“Kaempfer Finance”, “we”, “us” or “our”). They apply to www.kaempferfinance.com and any related pages, forms, calculators, calls and messages through which we offer our services (together, the “Platform”).
By accessing the Platform, submitting your details or using any of our services, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
2. About Kaempfer Finance and Our Services
Kaempfer Finance is a loan advisory and marketplace platform. We help you understand your options, compare offers and apply for loans such as personal loans, business loans, home loans, loans against property, commercial property loans, construction loans, repair and renovation loans and balance transfers.
Unless we clearly say otherwise, Kaempfer Finance is not the lender. Loans are offered and given by banks, non-banking financial companies (NBFCs) and other regulated financial institutions (“Lending Partners”). Your loan agreement, if you take a loan, will be with the Lending Partner and not with Kaempfer Finance.
3. Who Can Use the Platform
You may use the Platform only if you are at least 18 years old, are legally capable of entering into a binding contract under Indian law, and are using it for lawful purposes. If you apply on behalf of a company or firm, you confirm that you are authorised to do so.
4. Your Information and Responsibilities
When you use the Platform, you agree that:
- all information and documents you give us are true, accurate, complete and belong to you (or you are authorised to share them);
- you will update us promptly if any of your details change;
- you will keep any OTPs, passwords and account details confidential and will not share them with anyone; and
- you are responsible for all activity carried out using your details on the Platform.
Giving false or misleading information can lead to rejection of your application, cancellation of a loan and legal action by us or the Lending Partner.
5. Loan Offers and Lender Decisions
- Offers, interest rates, loan amounts, tenures and fees shown on the Platform or shared by our team are indicative and may change.
- Whether a loan is approved, the final amount, the rate and the terms are decided only by the Lending Partner, based on its own credit policy and checks.
- Submitting an enquiry or application through us does not guarantee approval or disbursal of a loan.
- Please read the sanction letter, loan agreement and key fact statement from the Lending Partner carefully before you accept any loan.
6. Calculators and Information on the Platform
The EMI calculators, eligibility indicators, rates and other content on the Platform are for general information and illustration only. Results are estimates based on the figures you enter and standard formulas. Actual EMIs, interest and charges may differ depending on the Lending Partner and your loan terms.
Nothing on the Platform is legal, tax, investment or financial advice. Please check with a qualified professional before you make a financial decision.
7. Fees and Charges
Unless we tell you otherwise in writing, you do not pay Kaempfer Finance anything to browse the Platform, use the calculators or submit an enquiry. Lending Partners may charge processing fees, foreclosure or part-payment charges, late payment charges, stamp duty, valuation and legal fees and other costs. These are set by the Lending Partner and will be disclosed in your loan documents.
Please do not make any payment to an individual claiming to be from Kaempfer Finance to “guarantee” or “release” a loan. If you receive such a request, tell us immediately.
8. Consent to Contact You
By submitting your mobile number or other contact details, you allow Kaempfer Finance and our Lending Partners to contact you by phone, SMS, WhatsApp, RCS and email about your enquiry, your application and related products and offers. This applies even if your number is registered on a Do Not Disturb or similar preference list.
You can withdraw this permission or opt out of promotional messages at any time by following the opt-out instruction in the message or by writing to us at the email address given below.
9. Credit Information
To assess your eligibility, we or our Lending Partners may, with your consent, obtain your credit score and credit report from credit information companies. Checking your eligibility on the Platform is intended to avoid a hard enquiry on your credit report, but a Lending Partner may carry out its own credit checks when you proceed with a formal application.
10. Acceptable Use
You agree not to:
- use the Platform for any unlawful, fraudulent or misleading purpose;
- submit false details, forged documents or another person’s information without their permission;
- copy, scrape, harvest or collect content or data from the Platform using bots or automated tools;
- interfere with the security or working of the Platform, or try to gain unauthorised access to it;
- upload viruses, malicious code or anything that could harm the Platform or other users; or
- use the Platform to send spam or to harass, abuse or impersonate anyone.
11. Intellectual Property
All content on the Platform, including text, graphics, logos, icons, images, calculators, software and the design and layout, belongs to Kaempfer Finance or its licensors and is protected by applicable intellectual property laws. You may view and use the Platform for your personal, non-commercial use. You may not copy, modify, distribute, sell or create copies of any part of it without our written permission.
12. Third-Party Links and Services
The Platform may link to websites or services run by Lending Partners or others. We do not control these and are not responsible for their content, terms, policies or practices. Your use of them is at your own risk and under their own terms.
13. Disclaimers
We work to keep the information on the Platform accurate and up to date, but the Platform and all content are provided on an “as is” and “as available” basis. To the extent permitted by law, we do not promise that:
- the Platform will always be available, secure or free from errors or interruptions;
- the information, rates or offers are complete, current or suitable for your needs; or
- any loan application will be accepted or any particular outcome will be achieved.
14. Limitation of Liability
To the maximum extent permitted by law, Kaempfer Finance, its directors, employees and affiliates will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, income, data or goodwill, arising from your use of or inability to use the Platform, or from any decision, act or omission of a Lending Partner.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
15. Indemnity
You agree to compensate and hold harmless Kaempfer Finance and its directors, employees and affiliates from any claim, loss, damage or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or any false information or documents you provide.
16. Suspension and Termination
We may suspend or stop your access to the Platform at any time, without notice, if we believe you have broken these Terms, given false information or used the Platform in a way that could harm us, other users or our Lending Partners. You may stop using the Platform at any time. Sections that by their nature should continue, such as those on intellectual property, disclaimers, liability and indemnity, will continue after termination.
17. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, share and protect your personal information.
18. Changes to These Terms
We may update these Terms from time to time. The updated Terms apply from the time they are posted on the Platform. Please check this page regularly. By continuing to use the Platform after an update, you accept the revised Terms.
19. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or the Platform will be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana, subject to any right you have under applicable consumer law.
